insurance refusing to paint

First off I apologize if I put this in the wrong place.

So basically about 3 weeks ago I got into an accident.

I went an got an estimate from a shop that I heard was a good shop. I go there and its this run down junkyard looking of a place. The guy the does the estimates was not there so there guy that does the body work came out and looked at it, after saying they could bend half of the pieces on my car rather than replacing them, he told me my car had been repainted before because it was two different colors. (WHICH ITS NOT, it is still the factory paint). My car has not been repainted before and actually the girl who owned it before me kept it under a car cover since the day she bought it brand new.

So without me telling the body the shop to submit the estimate of $670, they submitted it to the "at-fault" drivers insurance company. However I didn't get paid for that estimate since I told them I wanted to go somewhere else.

I went to a more reputable body shop that is really nice and clean and professional, and they work directly with the insuurance. They gave me an estimate of over $1300. I told them to submit it and I took my car in to get the work done yesterday. They called me with an update today and told me that my failing clear coat
( about an 8" long 3" wide strip) above my driver side back window had to be sanded down, base painted and re-clear coated. He told me the insurance company was informed before I dropped my car off that they were responsible for repainting that panel and I was told of no disputes.... until today.
They already sanded down that panel and then afterwards called the insurance company to see if they would pay for it and never told me they were touching that part.
Anyways the body shop called and said the insurance company refused to pay for it since the first body shop told them my car was painted previously, and now the body shop is coming to me for payment.
Basically what I'm wanting to know is if I'm in the wrong to be passed off? And what can I do to resolve this, besides raising hell with the insurance company which I already plan to do tomorrow?
Do I need to get a lawyer If they don't agree to paint it tomorrow?

if the 2nd shop can prove tht the damage was due to the accident, they can get the insurance company to pay the difference

The spot they are refusing to paint was not damaged by the wreck, but they have to paint that area to blend in the paint color because part of that panel was hit.

Do you have recent pictures of your car before the accident to submit?

Not of that area, but they are refusing to paint it because some idiot at another body shop told them its been repainted and they feel the clear coat is failing in that spot due to sub par painting... Which it hasn't been repainted btw.

tht, to me, is enough proof tht the insurance needs to cover it... i'm surprised your bodyshop doesn't know how to handle this situation...have them call the insurance again and state their case..

I called the insurance and they didn't back down, so I'm going to have them call and deal with it themselves. Or this can get legal.

insurance doesn't care wht u say... they care abt what the bodyshop says
