I do agree the passenger had his own responsibility to buckle his own seatbelt. I kind of doubt the passenger was like "Hey Nick, don't race this guy! Slow down!" You know what I mean?

I think the seatbelt law in California works opposite of what Hogan's possible defense would be. As per CA seatbelt law, the driver is also responsible for his passenger's seat belts. That is based on my brother's experience.
