Off technicality OP you're right, however this something I think you should have just shrugged your shoulders and said meh to yourself, what are you losing out of it? Plus its a free item so his lost is someone potential gain in profit or personal usage. If everything was done with a technicality perspective then you as all of have broken rules daily and should be summoned or jailed.
